01Website terms and service contracts
These terms govern use of this Ohmsakthi Techno website. Use it lawfully and only for purposes consistent with these terms. Do not use it if you cannot comply. A request for information does not by itself create a paid engagement, employment relationship, or obligation to supply services.
IT outsourcing, managed services, Zoho and ServiceNow consulting, cloud, development, automation, and integration work require a mutually agreed written scope or contract. An applicable signed agreement controls service-specific matters where it conflicts with general website wording, subject always to mandatory law.
02Scope, delivery and changes
Deliverables, assumptions, dependencies, milestones, acceptance criteria, staffing, locations, working-hour overlap, support coverage, and escalation arrangements must be agreed for each engagement. Website descriptions are indicative capabilities, not a promise of fixed results, 24/7 support, or guaranteed response times.
Changes in scope, requirements, client systems, vendor products, or access may affect delivery and price. Agree material changes in writing. Production deployments, destructive operations, migrations, and security testing require appropriate authorization and an agreed change process.
03Client responsibilities and authorized access
Clients must provide accurate requirements, lawful instructions, timely decisions, and necessary licensed access. Do not provide data or systems that you lack authority to share or administer. Agree access roles, backups, recovery responsibilities, test data, and acceptance procedures before work begins.
Personal data should be minimized, with confidentiality, permitted processing, subprocessors, retention, return or deletion, and incident cooperation documented as appropriate. Overseas clients must identify applicable sector rules, transfer restrictions, and localization requirements. Do not transfer secrets or production data through this public website.
04Fees, taxes and cancellation
Pricing, currency, GST and other taxes, invoice timing, payment milestones, third-party costs, cancellation, termination, refunds, and transition assistance are governed by the accepted quotation or service agreement. This site has no online checkout and creates no automatic subscription or payment authorization.
No blanket non-refundable-fee rule is imposed by these website terms. Any refund or termination arrangement must follow the applicable contract and mandatory legal rights. Independently verify payment instructions through a known company contact before paying.
05Intellectual property and confidentiality
Website text, branding, illustrations, and code are owned by Ohmsakthi Techno or used under applicable rights. You may browse and reference the site for legitimate business purposes; copying or reuse beyond applicable legal exceptions requires permission from the relevant rights holder.
Project ownership, source code delivery, licenses for reusable components, open-source notices, and rights in pre-existing materials must be set out in the engagement agreement. Third-party software remains subject to its own license. Confidential project information should be exchanged only under suitable confidentiality and access arrangements.
06Third-party platforms and outsourcing
Zoho, ServiceNow, cloud providers, email services, and other vendors control their own products, subscriptions, licensing, availability, and changes. Their terms may apply separately. Do not assume that a named platform license, subscription, vendor support, or official partnership is included unless expressly confirmed in the contract.
For outsourced teams, agree personnel roles, supervision, availability, approved access, subcontracting, handover, and location requirements. Project staffing does not itself create direct employment or a partnership between the client and individual personnel.
07Acceptable use and cybersecurity
Do not attempt unauthorized access, credential theft, malware distribution, data extraction, denial-of-service, impersonation, or interference with this site or connected systems. Do not evade access controls or conduct penetration testing without written permission from the owner of the affected system.
Suspicious activity may be investigated, restricted, and reported as required by law. Applicable incident reporting, evidence retention, and lawful regulatory cooperation duties take precedence over inconsistent confidentiality expectations. A vulnerability report does not itself authorize testing or create a bug-bounty reward.
08Availability, liability and statutory rights
Website information may contain errors or become outdated. To the extent allowed by law, the website is provided without a guarantee of uninterrupted availability, completeness, fitness for a particular purpose, or freedom from security incidents. Seek a written assessment before relying on technical or commercial information for a deployment.
Liability for paid services is governed by the applicable contract. Any permitted restriction on website-related liability applies only to the extent lawful. Nothing excludes non-excludable statutory duties or remedies, or liability that cannot legally be limited, including for fraud or wilful misconduct. No provision overrides applicable consumer protections.
09Indian law and disputes
These website terms are governed by Indian law. Parties should first raise a concern with the company and seek a practical resolution. Subject to mandatory law and a valid written agreement, courts with competent jurisdiction in Chennai, Tamil Nadu may hear website-related disputes. This clause does not remove access to a statutory regulator, tribunal, consumer forum, or another forum mandated by law.
These terms do not impose automatic arbitration. Service-specific governing law, dispute handling, and international delivery obligations may be agreed separately, subject to applicable law.
10Updates and contact
Updated terms will be posted with a revised date and apply prospectively. Changes to a signed engagement require the process agreed in that contract; a website revision does not silently amend a service agreement.
